Law360, New York (January 11, 2012, 4:10 PM ET) -- A New Mexico judge on Tuesday agreed to stay legal appeals over a rule governing waste from drilling operations, a victory for the state oil and gas industry as it attempts to loosen the rule administratively.
The rule, known as the pit rule, governs how wastewater left over from drilling can be stored in open pits, buried tanks and closed-loop systems. The rule is meant to protect groundwater from the seep of toxic chemicals and, for example, requires that pits be properly lined.
