6th Circ. Sees No Fraud In Nationwide's Loan To Agent

Law360, New York (January 13, 2012, 4:58 PM EST) -- The Sixth Circuit affirmed Friday that Nationwide Mutual Insurance Co. did not defraud a contractor when it issued her a loan to open a new office under an initiative it allegedly promised would prosper but that proved unsuccessful.

A three-judge panel upheld a Michigan federal court's summary judgment ruling against plaintiff Karen Nemier's claims for fraud and breach of contract. Nemier had attempted to argue that important factual questions regarding Nationwide's actions were still in dispute, but the appeals court disagreed.
