Law360, New York (January 13, 2012, 6:42 PM ET) -- The Federal Circuit on Friday agreed to consider whether antitrust allegations related to fraudulent patent procurement can be raised by direct purchasers, in SanDisk Corp.'s appeal of a trial court's refusal to dismiss Ritz Camera & Image LLC's class action against the flash memory maker.
The appellate court granted Sandisk's midtrial petition for permission to appeal a California court's September ruling that denied the company's attempts to dismiss Ritz's suit alleging Sandisk used false patents and sham litigation to maintain a monopoly on flash memory....
