IASIS Wins Sanctions Over Privileged Docs In FCA Case

Law360, New York (January 17, 2012, 8:56 PM ET) -- IASIS Healthcare Corp. won part of its bid for sanctions against opposing counsel last week in a whistleblower False Claims Act case against it, with an Arizona federal court finding that the counsel had improperly held onto IASIS documents protected by attorney-client privilege.

The court found that counsel for the qui pro tam plaintiff, led by attorneys with Phillips & Cohen LLP, had held onto three privileged documents without notifying IASIS or seeking a court's opinion as to whether they were privileged.
