DC Circuit Won't Undo FERC's Cap On Rates

Law360, New York (January 18, 2012, 4:15 PM ET) -- The D.C. Circuit refused Tuesday to review Federal Energy Regulatory Commission orders capping rates that El Paso Natural Gas Co. could charge certain shippers for using its western gas pipeline, weighing in on a saga stemming from a 1996 deal.

FERC's decision to cap the rates was reasonable in light of the fact that it used its standard approach for calculating rates, the appeals court said in a 22-page opinion refusing to review FERC orders tied to the pipeline.
