Feds Push For 1st Circ. To Reopen FCA Suit Against Pfizer

Law360, New York (January 18, 2012, 6:55 PM ET) -- The federal government asked the First Circuit on Tuesday to revive an ex-Pfizer Inc. executive's False Claims Act suit alleging the drug giant paid kickbacks to doctors who prescribed its human growth hormone drug Genotropin.

While the U.S. government did not intervene in the qui tam action, it said it had filed the amicus brief because it had a major and ongoing interest in ensuring the FCA could be deployed in qui tam suits centered on kickback claims.
