Law360, New York (January 20, 2012, 1:34 PM ET) -- A California federal judge on Thursday dismissed two of four claims facing Daimler AG in a proposed class action accusing the carmaker and Mercedes-Benz USA LLC of hiding dangerous defects in their vehicles' radiators from consumers.
Daimler and Mercedes-Benz knew about the problems but refused to recall the radiators, instead dealing with customer complaints through secret repair and replacement programs, according to a second amended complaint filed by plaintiff Nadia Kas.
