9th Circ. Affirms Class Denial In Countrywide Suit

Law360, New York (January 20, 2012, 6:54 PM ET) -- The Ninth Circuit on Friday affirmed denial of class certification in a suit accusing Countrywide Financial Corp. of misleading borrowers about the terms of their mortgage loans, but it recommended allowing an individual plaintiff to conduct further discovery.

In a one-paragraph ruling the appeals court affirmed U.S. District Judge Dana M. Sabraw's April 2010 decision refusing to certify a class of thousands of Washington state homeowners in the purported class action filed by Randall Buckley.
