Law360, New York (January 23, 2012, 7:24 PM ET) -- Abbott Laboratories sued Zydus Pharmaceuticals (USA) LLC in Delaware federal court Friday, alleging the drugmaker infringed its patent for Niaspan prescription niacin tablets by seeking regulatory approval to make a generic version of the cholesterol drug.
Zydus notified Abbott on Dec. 8 that it had filed an abbreviated new drug application with the U.S. Food and Drug Administration, seeking the right to market generic extended-release niacin tablets equivalent to Niaspan, according to the complaint.
