Ex-McKinsey Exec's $40M Suit Against Fund Tossed

Law360, New York (January 23, 2012, 10:12 PM EST) -- A New York state judge on Wednesday dismissed a former McKinsey & Co. senior partner's suit claiming a health care private equity fund he helped found owed him $40 million in unpaid compensation.

Judge Barbara R. Kapnick dismissed Richard N. Foster's complaint in its entirety, ruling that there was no evidence that Foster and his fellow founders of Caxton Health Holdings LLC had ever agreed to give him a 10 percent equity interest in the fund.
