Feds Defend Wiretaps In $230M National Lampoon Case

Law360, New York (January 24, 2012, 8:09 PM ET) -- Prosecutors urged an Indiana federal judge on Monday to keep intact securities fraud claims against National Lampoon Inc. CEO Timothy Durham over his alleged role in a $230 million investment scam, rejecting claims that the indictment is based on unauthorized wiretaps.

The government’s filing came in response to a motion by Durham to dismiss the case on the grounds that prosecutors did not seek the court’s permission to use wiretap evidence gathered from Durham’s phone before presenting a grand jury with securities fraud charges. In their...
