DOL Enforcement Of Breastfeeding Law Breeds Uncertainty

Law360, New York (January 30, 2012, 6:09 PM ET) -- The U.S. Department of Labor has begun enforcing a law requiring employers to provide break time for nursing mothers, but the agency has not yet issued final implementing rules, leaving employers in the dark about their obligations, attorneys say.

The DOL's Wage and Hour Division concluded 23 investigations under the nursing mothers provisions of the Fair Labor Standards Act in the 2011 fiscal year, and employers were cited for violations in 15 of those investigations, a department spokeswoman told Law360.
