Blue Cross Blasts Aetna's Antitrust Allegations

Law360, New York (January 30, 2012, 6:05 PM EST) -- Blue Cross Blue Shield of Michigan on Friday attempted to fend off a suit lodged by fellow insurer Aetna Inc., arguing that allegations that Blue Cross contracts with hospitals to assess higher costs against its competitors don't support an antitrust case.

Blue Cross said in its motion to dismiss the lawsuit in Michigan federal court that Aetna's complaint fails to demonstrate that the health insurance federation's purportedly exclusionary “most favored nation” contract agreements with Michigan-area hospitals constitute remediable antitrust activity.
