Oracle's Fraud Claim Over HP Exec Poaching Settlement Nixed

Law360, New York (January 31, 2012, 2:38 PM ET) -- The California judge presiding over Hewlett-Packard Co.'s contract suit accusing Oracle Corp. of shutting it out of the server market rejected on Monday Oracle's claims that HP had fraudulently induced Oracle into a settlement over the alleged poaching of a former HP executive.

California Superior Court Judge James P. Kleinberg allowed HP's demurrer against Oracle's countercomplaint fraud claims, which sought to undo a 2010 settlement agreement over Oracle's hiring of former HP chief executive Mark Hurd that had purportedly reestablished ties between the companies.
