US Defends Gulf Drilling Shutdown To 5th Circ.

Law360, New York (January 31, 2012, 8:07 PM EST) -- The federal government, seeking to reverse a Louisiana federal court's finding of contempt in a suit brought by Hornbeck Offshore Services LLC, defended its decision to shut down oil drilling in the Gulf of Mexico after the Deepwater Horizon explosion to the Fifth Circuit on Monday.

“When agency decision making comes in the context of a national crisis, the need for judicial restraint is at its highest,” the government said in its brief to the appeals court.
