Questions Linger Over NLRB's Social Media Guidance

Law360, New York (February 13, 2012, 9:31 PM EST) -- The National Labor Relations Board's report last month on social media-based labor cases showed the agency is grappling with how to apply long-established law to the modern workplace, and lawyers watching the agency's evolving approach say there are three areas where employers could use more guidance.

NLRB acting general counsel Lafe Solomon's Jan. 25 report was the second the agency has issued since August on the hot-button issue of how workers' social media communications intersect with the National Labor Relations Act.
