Law360, New York (February 02, 2012, 12:15 PM ET) -- A Minnesota federal judge on Wednesday upheld a motion compelling a confidential witness to testify in a shareholder class action alleging Medtronic Inc.'s stock price dropped because the medical device company pushed off-label uses for its Infuse spinal graft.
U.S. District Judge Paul A. Magnuson's ruling affirmed a magistrate judge's order for the witness, a former Medtronic employee known as CW2 in the filings, to testify and turn over a document that he tried to withhold by citing Fifth Amendment protection.
