Suppliers Not Liable For Welder's Disease: Calif. Court

Law360, New York (February 02, 2012, 1:40 PM ET) -- A California appeals court ruled Wednesday that suppliers Alcoa Inc., The Boeing Co. and several others could not be held liable for injuries sustained by a metal worker as a result of using their raw materials.

In affirming the dismissal of plaintiff John Maxton's case, the three-judge panel found that the suit did not present any of the "extraordinary circumstances" — such as the supply of contaminated or dangerous products — necessary to hold the raw material suppliers liable for negligence or under a strict products...
