Law360, New York (February 02, 2012, 4:26 PM ET) -- A Texas federal judge on Thursday refused to conditionally certify a class action against Wells Fargo Bank NA, saying the putative class of personal bankers had failed to identify a companywide, national policy to deny overtime pay in violation of the Fair Labor Standards Act.
U.S. District Judge Nancy F. Atlas denied lead plaintiff Raymond Richardson's motion for class certification, finding that Richardson had failed to show that putative class members were similarly and systematically denied overtime pay.
