CERCLA Doesn’t Apply To Consumer Products: 7th Circ.

Law360, New York (February 02, 2012, 7:22 PM ET) -- The Seventh Circuit on Thursday ruled that consumer products like personal vehicles are exempt from CERCLA cleanup liability, upholding the dismissal of a billing company's Indiana suit seeking reimbursement for cleanup costs incurred by a fire department.

The three-judge panel agreed with a lower court judge who said the Emergency Services Billing Corp. could not collect costs for cleanups at car accident sites under the Comprehensive Environmental Response, Compensation and Liability Act because personal vehicles are excluded from the act.
