4th Circ. Backs Rejection Of Circuit City Class Claims

Law360, San Diego (February 2, 2012, 10:06 PM EST) -- The Fourth Circuit on Thursday affirmed the dismissal of class proofs of claim by former Circuit City Stores Inc. employees in the consumer electronics retailer’s Chapter 11 case, but used a different procedural approach than the lower court that leaves the door open for plaintiffs to file class proofs of claim.

In upholding the dismissal, the three-judge panel found that the bankruptcy court ruled within its discretion that the bankruptcy process would be superior to the class action process for resolving the claims of former employees...
