San Francisco Fights To Toss Suit Over Health Law

Law360, New York (July 26, 2007, 12:00 AM EDT) -- The city of San Francisco is aiming to throw out an ERISA lawsuit brought by a restaurant trade group seeking to overturn the city’s landmark new ordinance to extend health coverage to its uninsured residents.

The Golden Gate Restaurant Association, a group responsible for preventing similar measures in Maryland and New York, has claimed that the city’s ordinance violated the federal Employee Retirement Income Security Act, which prohibits state and local governments from requiring employers to revise their employee benefits plans.
