Wrigley, Cadbury Tussle Over Gum Patents In Fed. Circ.

Law360, Washington (February 07, 2012, 4:25 PM ET) -- Wm. Wrigley Jr. Co. asked the Federal Circuit on Tuesday to undo a lower court's finding that part of its chewing gum flavoring patent was invalid, saying that only in retrospect can the patented combination of flavoring agents seem obvious.

Wrigley filed the suit in 2004, alleging that Cadbury's Dentyne Trident brand gums infringe one of its patents for chewing gum with “physiological cooling agents.” Cadbury countersued, alleging that several varieties of Wrigley gums and mints, including Doublemint, Winterfresh and Eclipse, infringe Cadbury's patent for “breath-freshening...
