FTAIA Dispute To Face Full 7th Circ. In Potash Case

Law360, New York (February 7, 2012, 8:41 PM EST) -- The Seventh Circuit will take a second crack Wednesday at the question of just how far U.S. antitrust law can reach into foreign commerce as it considers whether to revive a class action accusing international potash producers of price-fixing.

A three-judge panel tossed the suit in September, ruling that the plaintiffs — largely fertilizer companies — had not drawn a sufficient connection between the alleged plot involving foreign producers and the U.S. potash market to satisfy the requirements of the Foreign Trade Antitrust Improvements Act....
