Bavarian Nordic, Acambis Settle Smallpox Fight

Law360, New York (July 26, 2007, 12:00 AM EDT) -- Bavarian Nordic and Acambis have settled a global patent feud over a smallpox vaccine, ending a fight that has lasted at least two years, the two companies said Wednesday.

Under the agreement, Denmark-based Bavarian Nordic will grant a license to some Modified Vaccina Ankara-based patents in exchange for an “undisclosed upfront payment” from Acambis.

U.K.-based Acambis will also make royalty and milestone payments if it develops or commercializes certain MVA products in the future, the companies said. Other terms of the agreement are confidential.
