Law360, New York (February 06, 2012, 10:18 PM ET) -- A New Jersey federal judge on Monday shot down Ford Motor Co. E-350 van owners’ revised motion for class certification in a multidistrict litigation claiming the vehicles are defective, finding many of their common issues too individualized and requested relief inappropriate.
In an 86-page opinion, U.S. District Judge Esther Salas rejected the van owners' claims of misrepresentation, injury, deception, and breach of implied and express warranty — the second time certification has been denied in the long-running MDL.
