Italy Heads To EU High Court Over Illegal State Aid

Law360, New York (February 8, 2012, 5:20 PM ET) -- The European Commission referred Italy to the European Court of Justice on Wednesday for failing to recover €18 million ($24 million) in preferential electricity tariffs the commission claims Italy distributed to three Sardinia-based metal production projects in violation of competition rules.

To date, Italy has not complied with the EC's February 2011 order to take back operating aid the Italian government granted years earlier in the form of subsidized electricity tariffs to Portovesme SRL, Eurallumina SPA and ILA SPA, the commission said in a statement Wednesday....
