Espada Accuses Gov't Of Misconduct In Record Seizure

Law360, New York (February 9, 2012, 8:33 PM EST) -- Former New York state Sen. Pedro Espada Jr. and his son asked a federal court Wednesday to consider dismissing the embezzlement case against them, leveling new claims that the government disregarded a warrant in seizing files from a health care nonprofit's computer.

Espada and his son Pedro G. Espada face an 18-count superseding indictment claiming they embezzled more than $500,000, including federal grant money, from the Espada's nonprofit Soundview Healthcare Network. The pair have pled not guilty on all counts.
