Lorillard Sales Reps Fail To Meet Class Cert. Bar

Law360, New York (February 09, 2012, 8:14 PM ET) -- An Alabama federal judge last month refused to certify a class of Lorillard Tobacco Co. sales reps to bring claims — similar to those frequently asserted by pharmaceutical sales reps — that the company misclassified them as outside salespeople exempt from overtime pay requirements.

U.S. District Judge William Keith Watkins on Jan. 30 denied retired Lorillard sales rep James Pickering Jr.'s motion for conditional certification of his lawsuit accusing the tobacco company of violating the Fair Labor Standards Act as a collective action.
