Yums Urges High Court To Review Nike Trademark Case

Law360, San Diego (February 10, 2012, 5:53 PM ET) -- Shoe maker Yums LLC on Wednesday urged the U.S. Supreme Court to take up an intellectual property dispute with Nike Inc., arguing that a lower court improperly applied a jurisdictional rule that allowed Nike to escape an invalidity challenge to its trademark.

Yums filed a petition for a writ of certiorari after the Second Circuit in November affirmed that Nike’s covenant not to sue and voluntary dismissal of its suit alleging Yums’ shoes infringed its trademark divested a district court of jurisdiction over Yums’ counterclaims, claiming...
