Fed Circ. Upholds $371M Award In Bard Graft Patent Suit

Law360, New York (February 10, 2012, 9:17 PM ET) -- In a 2-1 precedential decision, the Federal Circuit on Friday upheld a damages award of $371 million for C.R. Bard Inc. in a long-running patent infringement suit against rival W. L. Gore & Associates Inc. over a patent covering a type of prosthetic blood vessel graft.

The appeals court affirmed an Arizona federal court’s decision to enhance a jury’s $185 million damages verdict to $371.2 million award as well as awarding attorneys’ fees and a royalty rate, finding there was substantial evidence to support the ruling. ...
