Merck, Bayer Target Watson Over Generic Beyaz Birth Control

Law360, Washington (February 10, 2012, 8:45 PM ET) -- Merck & Cie and Bayer Pharma AG sued Watson Pharmaceuticals Inc. in Delaware federal court on Friday, alleging the company's application to market a generic oral contraceptive infringes a Merck patent for Bayer's Beyaz.

The lawsuit was prompted by Watson's filing of an abbreviated new drug application with the U.S. Food and Drug Administration in January for female birth control tablets that have the same active ingredients as Beyaz pills, including drospirenone, levomefolate calcium and 17 alpha-ethinylestradiol, according to the complaint.
