Ex-Rutgers Player Asks 3rd Circ. To Revive EA Suit

Law360, New York (February 14, 2012, 1:22 PM EST) -- A former Rutgers University quarterback urged the Third Circuit on Friday to revive a class action claiming Electronic Arts Inc. had misappropriated college football players’ likenesses, arguing the athletes’ right-of-publicity was not automatically trumped by First Amendment freedoms. 

In a brief filed Friday, lead plaintiff Ryan Hart — who was the quarterback for Rutgers University’s football team from 2002 to 2005 — asked the Third Circuit to overturn a New Jersey federal judge’s dismissal of the case.
