Insurer Wants Out Of J&J Supplier's Bug Infestation Suit

Law360, New York (February 13, 2012, 10:43 PM EST) -- Essex Insurance Co. Inc. on Monday told a Florida federal court that it had no duty to defend a warehouse owner in a suit by a Johnson & Johnson supplier over an alleged beetle infestation in the facility.

In a motion for judgment on the pleadings, Essex said the legal liability insurance policy it issued to Smith Terminal Warehouse Co. specifically excludes coverage for damage from insects and vermin.
