4th Circ. Backs Restrictive BP Gas Station Agreement

Law360, New York (February 15, 2012, 5:12 PM EST) -- The Fourth Circuit on Tuesday overturned a ruling that a land purchase agreement between a gas station owner and a BP PLC unit that barred the sale of non-BP fuel was unenforceable, though a dissenting judge maintained the contract was overbroad.

A two-judge majority reversed a Virginia federal judge's summary judgment ruling against BP Products North America Inc. and remanded its suit against Charles V. Stanley Jr. and his business, Telegraph Petroleum Properties LLC, to the lower court.
