Fed. Circ. Nixes ClearValue's $2.2M Water Treatment IP Win

Law360, New York (February 17, 2012, 5:17 PM ET) -- The Federal Circuit on Friday reversed a jury's $2.2 million award for ClearValue Inc. in its infringement suit against Pearl River Polymers Inc., finding the water-treatment technology patent in dispute was anticipated by an earlier patent.

The appeals court ruled that a prior patent “teaches and enables” every element of a claim in the ClearValue technology patent-in-suit, reversing a federal judge's denial of Pearl River's bid for judgment as a matter of law on invalidity.
