DC Circ. Tosses Appeal In Nuclear Plant Permit Fight

Law360, New York (February 17, 2012, 6:35 PM EST) -- The District of Columbia Circuit on Friday dismissed an environmental group's appeal of the U.S. Nuclear Regulatory Commission's reinstatement of construction permits for an Alabama nuclear plant, saying the group challenged orders that are not reviewable by the court.

A three-judge appeals panel found that because the Blue Ridge Environmental Defense League petitioned to overturn two NRC actions that were not technically final orders, the court did not have standing to review the actions under the Hobbes Act.
