CIT Tosses Consolidated Challenge To Byrd Amendment

Law360, New York (March 2, 2012, 8:07 PM EST) -- The U.S. Court of International Trade on Thursday affirmed the constitutionality of the Continued Dumping and Subsidy Offset Act when it tossed a consolidated suit by plaintiffs claiming they were unlawfully denied domestic producer status under the law.

The suit was lodged against the U.S. International Trade Commission and U.S. Customs and Border Protection by a group of producers of processed crawfish tail meat and two ball bearing manufacturers, who claim they were unlawfully disqualified from the status, which would have allowed them to receive distributions...
