11th Circ. Limits Contribution Claims Under CERCLA

Law360, New York (March 06, 2012, 7:05 PM ET) -- A Monsanto Co. spinoff and a Pfizer Inc. predecessor cannot use the Comprehensive Environmental Response, Compensation and Liability Act's Section 107 to force others to cover cleanup costs stemming from a consent decree, the Eleventh Circuit held Tuesday in a precedential decision.

The decision upholds Solutia Inc. and Pharmacia Corp.'s summary judgment loss in a suit demanding that U.S. Pipe & Foundry Co. Inc. and a slew of other companies contribute toward an environmental cleanup near a Monsanto plant near Anniston, Ala., that produced polychlorinated biphenyls....
