CIT Tosses Ball Bearing Co.’s Byrd Amendment Suit

Law360, New York (March 7, 2012, 3:59 PM EST) -- The U.S. Court of International Trade on Tuesday threw out a suit challenging the constitutionality of the Continued Dumping and Subsidy Offset Act, finding that ball bearing maker NSK Ltd.’s claims were baseless or time-barred.

The CIT dismissed NSK's consolidated suit, agreeing with the U.S. government and intervening defendants Timken U.S. Corp. and MPB Corp., which argued that one of the ball bearing company's claims dating back to 2005 was time-barred and the others were too similar to those rejected by an earlier appeals court decision...
