7 States Urge 9th Circ. To Reject Calif. Carbon Cap

Law360, New York (March 13, 2012, 3:04 PM EDT) -- Attorneys general from seven states lodged a brief Monday with the Ninth Circuit opposing enforcement of California's Low Carbon Fuel Standard, arguing against California's motion to stay a lower court ruling that declared the standard unconstitutional.

Allowing the LCFS to come back into effect would "significantly impair" the economies of Nebraska, Iowa, Kansas, Michigan, Missouri, North Dakota and South Dakota by restricting the markets for corn and ethanol, the AGs wrote in Monday's brief.
