3rd Circ. Grants Arbitration In Tenet Meal Break Case

Law360, New York (March 14, 2012, 9:45 PM EDT) -- A trial court judge erred when she denied Tenet Healthcare Corp.'s motion to compel arbitration in a putative collective action, the Third Circuit said Wednesday, not swayed by a former Tenet unit employee's claims that she wasn't given time to mull over the underlying arbitration pact.

A three-judge panel issued a 31-page precedential opinion reversing the district court's order and remanding the case with instructions to stay the litigation and compel arbitration.
