Liquor Supplier Asks 8th Circ. To Revive Antitrust Suit

Law360, New York (March 16, 2012, 7:39 PM EDT) -- Johnson Brothers Liquor Co. on Wednesday urged the Eighth Circuit to revive a suit accusing Bacardi USA Inc. and Brown-Forman Corp. of violating antitrust laws by nixing distribution agreements, arguing that the judge overlooked key facts and misinterpreted antitrust law.

In a brief made public Wednesday, Johnson Brothers asked the appeals court to reverse a Minnesota federal judge’s order dismissing the case, saying the judge erred in finding actions by Bacardi and Brown-Forman did not place an unreasonable restraint on competition.
