Citing Dukes, Domino's Asks 8th Circ. To Nix Drivers' Cert.

Law360, New York (March 21, 2012, 4:40 PM ET) -- Domino’s Pizza LLC on Tuesday urged the Eighth Circuit to overturn class certification for Minnesota delivery drivers alleging the pizza chain improperly kept delivery charges, saying differences in customer experiences demanded that the claims be litigated on an individual level.

Domino’s argued in its brief that the appeals court should vacate a Minnesota federal judge’s order granting class certification to drivers in a suit claiming the pizza delivery chain had underpaid them by keeping delivery charges customers assumed were tips.
