Law360, New York (August 10, 2007, 12:00 AM ET) -- An appeals court has affirmed a lower court decision dismissing a suit brought by a man who alleged he was passed over for the president position at Des Moines Area Community College because he was black.
In its decision Wednesday, a three-judge panel of the U.S. Court of Appeals for the Eighth Circuit affirmed a ruling by the U.S. District Court for the Southern District of Iowa that tossed the claim brought by Fred Gilbert.
