Judge Approves Monsanto Radiation Settlement Minus Class

Law360, New York (March 23, 2012, 7:52 PM EDT) -- An Ohio federal judge on Friday approved a $240,000 settlement and class decertification in a 20-year-old suit against Monsanto Research Corp. and another ex-operator of a nuclear weapons facility alleging radioactive emissions from the complex lowered property values.

In issuing his preliminary approval, Judge Walter Herbert Rice agreed with both sides that the settlement "materially alters the case" so class certification is no longer superior to individual litigation.
