EPA Wants Sierra Club Suit Over Summary Notice Scrapped

Law360, New York (March 30, 2012, 6:47 PM ET) -- The U.S. Environmental Protection Agency asked the D.C. Circuit on Friday to toss a suit brought by the Sierra Club that challenges an EPA summary notice outlining past regulatory actions, arguing that the environmental group's suit is an improper and time-barred attack on the substance of emissions standards.

In a reply brief, the EPA argued that the notice in question was merely a summary of the EPA's previous regulatory efforts to monitor sources accounting for at least 90 percent of the aggregate emissions of various pollutants...
