Texas Court Can't Stomach Dismissal Of ConAgra Pot Pie Case

Law360, New York (April 03, 2012, 8:35 PM ET) -- A Texas appeals court on Tuesday found a lower court had been too quick to dismiss a woman's suit against ConAgra Foods Inc. claiming its frozen pot pies gave her food poisoning, finding legitimate questions of fact remained about whether ConAgra was responsible.

Because it had not been definitively proven that Deborah Johnson hadn't gotten food poisoning from the pot pie in question, the appeals panel said a trial court shouldn't have granted summary judgment in ConAgra's favor and remanded the case back to the lower...
