5th Circ. Health Law Challengers Indignant Over AG Letter

Law360, New York (April 6, 2012, 5:00 PM EDT) -- The appellants in a Fifth Circuit case challenging provisions of the 2010 health care law said Thursday they should be allowed to respond to Attorney General Eric Holder's Thursday letter on judicial review, especially Holder's claim that their case is “insubstantial.”

The appellants, an industry group representing physician-owned hospitals, asked the court Thursday evening for leave to respond, about six hours after the Justice Department filed Holder's letter.
