Fed. Circ. Backs Visa, Other Credit Cos. In SmartMetric IP Row

Law360, New York (April 11, 2012, 2:44 PM EDT) -- The Federal Circuit on Wednesday affirmed a ruling that Visa Inc., American Express Co. and MasterCard Inc. did not infringe SmartMetric Inc.’s patent covering contactless card payment technology, upholding the lower court’s interpretation of patent claims.

In a unanimous decision, the appeals court found that a California federal judge did not err in finding the three major credit card companies did not infringe SmartMetric’s patent, following a Markman ruling that adopted favorable claim constructions for the defendants.
